Key points

  • WhitePips sells access to evaluations and funded accounts that run on simulated capital. The fee is a one-time payment for a service, not a deposit or an investment, and payouts are rewards paid by WhitePips.
  • You must be 18 or older, hold one personal Account, trade it yourself, and not be resident, a national of, or located in a restricted jurisdiction.
  • The Plan Specification shown at checkout fixes the figures for your account. The Trading Rules and the Payout Policy govern how it is traded and paid.
  • Prohibited conduct, a chargeback or false information can end your accounts, void simulated profit and require you to repay rewards already paid.
  • Our liability is capped at the fees you paid in the previous 12 months. Saint Lucia law applies, and complaints come to us first.

This summary is here to help you find your way. It is not part of the Terms of Service and does not change it: the full text below is what applies.

1Introduction and acceptance

1.1

Welcome to WhitePips (“WhitePips”, “Company”, “we”, “our”, or “us”).

1.2

WhitePips is operated by WhitePip FX Ltd., an International Business Company registered in Saint Lucia under registration number 2026-00645, with its registered office at Unit 1, La Place Creole Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia and its office at Business Center, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.

1.3

These Terms of Service (“Terms”) govern your access to and use of the WhitePips website, trading evaluations, instant funding programs, partner programs, mobile applications, customer portal, educational content, and all related products and services (collectively, the “Services”).

1.4

By accessing or using any part of the Services, creating an account, purchasing a product, or continuing to browse our website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1.5

Electronic acceptance. When you create an Account or complete a purchase you may be asked to confirm your acceptance by ticking a box or pressing a button. That confirmation is your electronic signature and has the same effect as a handwritten signature. We keep a record of the version of these Terms you accepted and when you accepted it.

1.6

If you do not agree to these Terms, you must immediately discontinue using our Services.

1.7

Documents that form part of this agreement. These Terms incorporate, and must be read together with, the following documents (together with these Terms, the “Legal Documents”), each as updated from time to time:

  1. the Plan Specification of each Trading Account you purchase;
  2. the Trading Rules;
  3. the Payout Policy;
  4. the Refund Policy;
  5. the Risk Disclosure;
  6. the Privacy Policy;
  7. the Restricted Jurisdictions policy; and
  8. any additional conditions shown to you with a promotion, add-on or partner program when you accept it.
1.8

Summaries and headings. Key-point boxes, plain-English summaries, examples and headings are included for convenience only. They do not form part of these Terms and do not affect how they are interpreted.

Next2 Definitions and interpretation

2Definitions and interpretation

In these Terms, and in the other Legal Documents unless the context requires otherwise, the following words have the meanings below.

Account
Your registered user profile with WhitePips, through which you access the dashboard, make purchases and hold Trading Accounts.
Customer
Any person who registers for or purchases a Service. “You” and “your” refer to you as a Customer.
Evaluation or Challenge
Any assessment program offered by WhitePips in which a Trading Account must meet published objectives, such as a profit target, before a Funded Account is issued.
Instant Account
Any instant funding product offered by WhitePips, being a Trading Account issued as a Funded Account at purchase without an Evaluation.
Trading Account
A simulated or evaluation account provided through our platform, whether it is in an Evaluation stage or funded.
Funded Account
A simulated Trading Account on which payouts may be earned under the Payout Policy. A Funded Account remains simulated and holds no real capital.
Website
www.whitepips.com and all associated domains.
Platform
Any software, dashboard, portal, API, or trading interface provided by WhitePips, including third-party trading software made available through it.
Trading Platform
The third-party software on which a Trading Account is traded: MetaTrader 5 for the CFD and Instant product lines, and Volumetrica, with market data supplied over a dxFeed connection, for the Futures product line.
Product Line
One of the three lines of Services: CFDs, Futures and Instant.
Plan
A combination of Product Line, plan type and account size offered for sale.

Store Credit
A non-cash balance that can be used towards WhitePips products.

A failure to meet, or a violation of, a Plan Specification, the Trading Rules or these Terms. A hard breach ends the affected account stage; a soft breach is recorded as a warning or strike, as described in the Trading Rules.
Prohibited Conduct
Any conduct described in section 15 (Prohibited conduct) or prohibited by the Trading Rules.
KYC
Identity verification and related “know your customer” checks.
Restricted Jurisdiction
Any country, territory or region listed in, or described by, the Restricted Jurisdictions policy.
Maximum Allocation
The maximum combined account size one person may hold across all Trading Accounts, described in section 13 (Evaluation programs and funded accounts).
Partner
Any affiliate, introducing partner, or business partner approved by WhitePips.
2.1

Interpretation. In the Legal Documents: “including” and similar words mean “including without limitation”; the singular includes the plural and the other way round; “in writing” includes email and messages in the dashboard; a reference to a law includes that law as amended or replaced; and “Trading Day” has the meaning given in the Trading Rules.

Next3 Eligibility

3Eligibility

3.1

You represent and warrant, when you register and each time you make a purchase or use a Service, that:

  1. you are at least 18 years old and have reached the age of majority in your jurisdiction, whichever is higher;
  2. you have legal capacity to enter into binding agreements;
  3. you are not prohibited from using our Services under applicable laws, including the laws of the country where you live and the country where you are located;
  4. the information you provide is accurate and complete;
  5. you are acting on your own behalf, as an individual, and not for a company, fund, trading group or any other person;
  6. you are not a resident or national of, or located in, a Restricted Jurisdiction;
  7. you are not the subject of sanctions, and you are not owned or controlled by, or acting for, anyone who is; and
  8. the money and payment methods you use are your own and lawfully obtained.
3.2

One person, one Account. You may register and hold only one Account. An Account is personal to you and may not be shared, sold or transferred. You may hold more than one Trading Account within your Account, up to the Maximum Allocation.

3.3

A continuing requirement. You must continue to meet these requirements for as long as you use the Services, and you must tell us promptly at [email protected] if anything changes, including if you move to, or intend to spend time in, a Restricted Jurisdiction.

3.4

Staff and connected persons. Employees and contractors of WhitePips, and members of their household, may not buy Trading Accounts or receive payouts unless WhitePips has agreed in writing in advance.

3.5

WhitePips reserves the right to deny access to any person or jurisdiction at its sole discretion.

3.6

If you were not eligible. If we find that you did not meet these requirements, or that you misrepresented your eligibility, we may treat your Account and every Trading Account in it as void from the start. Simulated Profit is then void, unpaid payouts will not be paid, payouts already paid may be recovered under section 17 (Consequences of a breach), and Fees are not refunded except where the law requires.

Next4 Restricted jurisdictions

4Restricted jurisdictions

4.1

WhitePips does not offer or provide the Services to residents or nationals of, or persons located in, the following restricted jurisdictions: Iran, North Korea and the Palestinian Territories.

4.2

The following regions are restricted in the same way: Crimea, Sevastopol, Luhansk, Donetsk, Zaporizhzhia and Kherson (territory of Ukraine); Abkhazia and South Ossetia (Georgia); the Turkish Republic of Northern Cyprus; Somaliland; Transnistria (Moldova); and Nagorno-Karabakh.

4.3

WhitePips also treats as restricted any country or territory that is subject to comprehensive sanctions administered by the United States Office of Foreign Assets Control (OFAC), the European Union, the United Kingdom, or the United Nations, and any jurisdiction identified by the Financial Action Task Force (FATF) as a high-risk jurisdiction subject to a call for action.

4.4

The list of restricted jurisdictions may be updated from time to time to reflect applicable laws, sanctions, regulatory requirements, and WhitePips’s internal compliance policies, without prior notice. The current list is always available in the Restricted Jurisdictions policy.

4.5

Attempting to access or use the Services from a restricted jurisdiction, including through the use of a VPN, proxy, or any other means of concealing your actual location, constitutes a material breach of these Terms.

4.6

WhitePips may decline to open, and may suspend, restrict, or terminate, any Account where it determines that these restrictions apply. Eligibility is verified at signup and again during identity (KYC) verification.

Next5 Nature of the Services

5Nature of the Services

5.1

WhitePips provides proprietary trading evaluation programs and related services.

5.2

Simulated accounts only. Every Trading Account, whether in an Evaluation or funded, is a simulated account in a demo trading environment. Prices may be derived from live market data, but no order you place is sent to an exchange, broker or other trading venue, you never acquire or own any financial instrument, and no capital of yours or of WhitePips is placed at market risk. References to “balance”, “equity”, “profit”, “loss” and “capital” describe simulated figures.

5.3

Unless expressly stated otherwise:

  1. evaluation accounts are simulated trading environments;
  2. performance during an evaluation does not guarantee future funding;
  3. participation does not establish an employment relationship; and
  4. participation does not create a partnership, agency, or joint venture.
5.4

Evaluation and education. The Services are a paid assessment of trading skill against objective, published criteria, together with the tools, data and educational content that support it. The outcome depends on how you trade.

5.5

No deposit and no investment. The Fee is the price of a service. It is not a deposit, an investment, a loan, or a contribution to capital or trading capital. It is not held on trust or in a segregated account for you, it earns no interest, and no part of it is placed at market risk. You acquire no ownership of, or claim to, any simulated balance.

5.6

Nothing within our Services constitutes investment advice, financial advice, portfolio management, or brokerage services.

5.7

No brokerage, advisory or fiduciary relationship. WhitePips does not hold client money, execute orders for you, manage your assets or give personal recommendations. No fiduciary, advisory or brokerage relationship exists between you and WhitePips.

5.8

Not a securities offering. The Services are not an offer of securities, units in a collective investment scheme, deposits, insurance or any other investment product, and they are not a lottery, game of chance or gambling service.

5.9

Regulatory status. Unless the Website expressly states otherwise, WhitePips is not authorised or regulated by a financial services regulator and the Services are not regulated financial services. The protections that apply to regulated investment or brokerage services, such as deposit guarantee and investor compensation schemes, do not apply.

5.10

Rewards. Payouts are rewards paid by WhitePips from its own resources, as provider of the Services, by bank transfer, in cryptocurrency or as Store Credit, on the conditions in the Payout Policy. They are not a return on an investment, not the proceeds of real trades, and not wages or salary.

5.11

Independent contractor. To the extent you receive payouts, you do so as an independent contractor. You are not an employee, worker, partner or agent of WhitePips, you have no authority to bind WhitePips, you are not entitled to employment benefits, and you are solely responsible for your own taxes, social security contributions and any business registration that applies to you.

5.12

Our use of trading data. WhitePips may analyse and use trading data from Trading Accounts for any lawful purpose, including risk management, product development and research, and may take decisions about its own trading activity, including positions in live markets on its own account, by reference to that data. You have no entitlement to, and no liability for, any such activity or its results.

5.13

Changes to the Services. We may add, change, suspend or discontinue any Product Line, Plan, instrument, feature, Trading Platform or data provider at any time. A change will not reduce the Plan Specification of a Trading Account you have already bought, except where the change is required by law, by a sanctions or compliance obligation, or by a Trading Platform or data provider, or is needed to prevent Prohibited Conduct.

Next6 Account registration and security

6Account registration and security

6.1

To access certain Services, you must create an Account.

6.2

You agree to:

  1. provide truthful information;
  2. keep your information current;
  3. maintain the confidentiality of your login credentials; and
  4. notify us immediately of unauthorized access.
6.3

You remain responsible for all activity conducted through your Account.

6.4

Your name and email. The name on your Account must be your full legal name as it appears on your government-issued identification, and your email address must be one you control and check.

6.5

Trading Account credentials. Login credentials for each Trading Account are issued to your dashboard. They are personal to you, must be kept secure, and may be reset or rotated by WhitePips at any time for security reasons.

6.6

No sharing and no third-party access. Only you may log in to your Account and place trades on your Trading Accounts. You must not allow anyone else, including a family member, friend, mentor, signal provider, account manager or paid “passing” service, to access or trade them, and you must not sell, rent, lend or transfer any Account or Trading Account.

6.7

Security. You must use a strong password that you do not use elsewhere, keep your devices secure, and use any additional security features we make available. WhitePips is not liable for any loss arising from unauthorised use of your Account that results from your failure to keep your credentials or devices secure.

6.8

Closing your Account. You may close your Account at any time by writing to [email protected]. Closing your Account ends every Trading Account in it. Fees are not refunded except as set out in the Refund Policy, payout requests made before closure are handled under the Payout Policy, and some information is kept after closure as described in the Privacy Policy.

6.9

Inactive Accounts. We may close an Account that has had no purchase, login or trading activity for an extended period, after sending a notice to your registered email address.

Next7 Identity verification (KYC)

7Identity verification (KYC)

7.1

WhitePips may require identity verification at any time.

7.2

Verification may include:

  1. government-issued identification;
  2. proof of address;
  3. selfie verification, including liveness checks;
  4. source of funds documentation;
  5. proof that you own the payment method, bank account or crypto wallet you use; and
  6. additional compliance checks, which may include a short video call.
7.3

When verification happens. Verification is normally required before your first payout is paid. We may also require it before a Funded Account is issued, when your details change, when you approach the Maximum Allocation, when a fraud, sanctions or compliance concern arises, or at any other time we reasonably consider appropriate.

7.4

Matching details. The name and country on your identification must match your Account, and the payment methods, bank accounts and crypto wallets you use must be in your own name or under your own control. Your country of residence and your nationality must not be a Restricted Jurisdiction.

7.5

Verification providers. We may use third-party identity verification providers, who process your documents and images on our behalf as described in the Privacy Policy.

7.6

Failure to complete verification may result in delayed payments, suspension, or permanent closure of your Account.

7.7

Failed or false verification. If you do not complete verification within the time stated in our request, if the documents you provide are false, altered or belong to someone else, or if verification shows that you are not eligible, we may void Simulated Profit, decline payouts, close your Account and every Trading Account in it without refund, and report the matter where the law requires.

7.8

Verification is not permanent. We may ask you to verify again, for example when a document expires, or when we detect a new device, location or payment method.

7.9

Limits on explanation. Where the law does not allow us to explain a verification or compliance decision, we will not explain it.

Next8 Anti-money laundering, sanctions and fraud prevention

8Anti-money laundering, sanctions and fraud prevention

8.1

WhitePips operates anti-money laundering, sanctions and fraud prevention controls. References in the Legal Documents to the AML Policy or the KYC Policy refer to those controls, including section 7 (Identity verification (KYC)) and this section.

8.2

Screening. We screen customers, payment methods, bank accounts, crypto wallets and payouts against sanctions lists maintained by OFAC, the United Nations, the European Union and the United Kingdom, against lists of politically exposed persons, and for fraud indicators, when you register and on an ongoing basis.

8.3

Your obligations. You must not use the Services to launder money, finance terrorism, evade sanctions or taxes, or move the proceeds of crime, and you must not make or receive payments for anyone else.

8.4

What we may do. Where we suspect any of these, or where the law requires it, we may refuse, delay or reverse a transaction, withhold or freeze payouts, request more information, suspend or close Accounts, and report to the competent authorities, in each case without telling you where the law prohibits it.

8.5

Compliance actions. WhitePips is not liable for any loss, delay or missed opportunity resulting from action it takes in good faith to comply with anti-money laundering, sanctions or fraud prevention obligations.

Next9 Purchases, fees and pricing

9Purchases, fees and pricing

9.1

All purchases are subject to the pricing displayed at the time of checkout.

9.2

What a Fee buys. Unless the checkout says otherwise, the Fee for a Trading Account is a one-time fee for one Trading Account on the Plan Specification you selected, for as long as that Trading Account remains in good standing. It is not a subscription and does not renew.

9.3

Unless required by applicable law:

  1. fees are non-refundable;
  2. completed purchases cannot be cancelled; and
  3. promotions may be withdrawn without notice.
9.4

Refunds. The circumstances in which a Fee can be refunded are set out in the Refund Policy.

9.5

Displayed and list prices. Where a higher list price is shown struck through beside the price charged, you pay the price charged. Add-ons and any transaction fee are shown at checkout and included in the total before you pay.

9.6

Bundle discounts. When you buy more than one Trading Account in one order, a bundle discount may apply to the whole order. At the date of these Terms it is 10% for two accounts, 15% for three, 20% for four and 25% for five, with a maximum of five accounts in one order. The discount shown at checkout is the one that applies. If a Trading Account in a bundle is later refunded or charged back, we may recalculate the discount for the rest of the order.

9.7

Priced options. Some Plans are sold with priced options that change the Plan Specification, for example a futures plan sold both without a daily loss limit and, at a lower price, with one. The option you choose at purchase is fixed for that Trading Account unless we agree otherwise.

9.8

Add-ons. Where add-ons are offered, such as a profit split upgrade, a swap-free option or Weekend Holding, they change the Plan Specification only as described at checkout, apply only to the Trading Account they were bought for, and cannot be transferred. A Trading Account without an add-on is held to the rule the add-on would have lifted. On a CFD Trading Account without Weekend Holding, positions still open at 4:45 PM New York time on Friday are closed automatically by our systems; the first time is a formal warning and the second time closes the Trading Account, as set out in the Trading Rules, section 12 (Weekend and overnight holding). Without the swap-free option, swaps are charged at the daily rollover.

9.9

WhitePips reserves the right to correct pricing errors before or after payment. Where a price was clearly wrong, we may cancel the order and refund what you paid, or ask you to pay the correct price before the Trading Account is issued or continues.

9.10

Price changes. We may change prices, Plans and discounts at any time. A change does not affect an order that has already been paid for.

9.11

Currency and conversion. Prices are shown in US dollars unless stated otherwise. Your bank, card issuer, exchange or payment provider may apply its own conversion rate and fees, which you bear.

9.12

Taxes, duties, and local government charges remain the responsibility of the customer unless otherwise required by law. Where we must charge a tax, it is shown at checkout.

Next10 Promotions and discount codes

10Promotions and discount codes

10.1

From time to time we may offer promotions, discount codes, free or discounted resets, competitions or promotional credit. Each promotion is subject to these Terms and to any conditions published with it. References in the Legal Documents to the Bonus & Promotions Terms refer to this section and those conditions.

10.2

Unless a promotion says otherwise:

  1. only one discount code may be used per order, and codes cannot be combined with other offers;
  2. a discount code comes off the price of the first Trading Account in an order only, and does not apply to further accounts in the same order or to add-ons;
  3. codes and promotional credit have no cash value, cannot be exchanged for cash or payouts, and cannot be sold or transferred;
  4. a promotion may be limited to new customers, to one use per person, household, device or payment method, and to a stated period; and
  5. a promotion may be changed or withdrawn at any time, without affecting orders already paid for.
10.3

Abuse of promotions. Opening additional Accounts, using someone else’s details, publishing a personal or restricted code, referring yourself through a Partner link, or otherwise obtaining a promotion you are not entitled to is Prohibited Conduct. We may cancel the promotion, charge the undiscounted price, or void the Trading Accounts obtained with it.

Next11 Payments

11Payments

11.1

Payments may be processed through third-party payment providers.

11.2

Checkout payment methods. Depending on your country and the order, checkout may offer payment by card, Apple Pay, Google Pay, UPI, bank transfer, cryptocurrency, QR code, Skrill or Binance Pay. The methods shown at checkout are the ones available to you. Some methods are provided through a hosted checkout operated by a payment provider, and any transaction fee for the method you choose is shown before you pay.

11.3

WhitePips does not store complete payment card information.

11.4

Customers authorize WhitePips to process applicable charges associated with purchased Services.

11.5

Your own payment method. You must pay with a payment method or wallet that belongs to you and is in your name. Payments by third parties are not accepted, and using a payment method without its owner’s authority is fraud.

11.6

Confirmation. A Trading Account is issued only once payment is confirmed. If a payment is later reversed, declined, recalled or found to be unauthorised, we may suspend or close the Trading Account and any account that came from it.

11.7

Paying by bank transfer. If you pay by bank transfer, the Trading Account is issued once the funds are received and matched to your order. Include the payment reference exactly as shown. Your bank’s fees, intermediary bank fees and currency conversion costs are yours, and a transfer that arrives short may be returned or treated as incomplete.

11.8

Paying in cryptocurrency. Where you pay in cryptocurrency, you must send the exact amount requested, in the asset and on the network shown, within the time allowed. Amounts sent in the wrong asset, on the wrong network, to the wrong address, short or late may be unrecoverable, and WhitePips is not responsible for them. Network fees are yours.

11.9

Payment providers. Payment providers act under their own terms. WhitePips is not responsible for their availability, decisions or errors, but will reasonably help you resolve a payment problem with them.

Next12 Chargebacks and payment disputes

12Chargebacks and payment disputes

12.1

If you believe a charge is incorrect, contact us first at [email protected] so that we can resolve it under the Refund Policy.

12.2

A chargeback is a breach. Starting a chargeback, payment dispute or payment reversal for a Service that was validly provided, without first giving us a fair opportunity to resolve the issue, is a material breach of these Terms.

12.3

What we may do. When we are notified of a chargeback or dispute we may, without further notice:

  1. suspend your Account and every Trading Account in it while the dispute is open;
  2. close the disputed Trading Account and any account that came from it, and void its Simulated Profit;
  3. withhold pending payouts and set off the disputed amount against anything otherwise payable to you;
  4. refuse future purchases from you and from payment methods, devices and persons connected with you; and
  5. contest the dispute, giving the payment provider evidence such as order records, your acceptance of these Terms, login and IP records, and trading history.
12.4

Costs. If a chargeback or dispute is decided in our favour or withdrawn, or was raised in breach of this section, you must repay the amount charged back together with any chargeback fees and reasonable collection costs we incur. We may recover them by set-off or by any other lawful means.

12.5

Our errors. If a dispute arises from a genuine error on our part, we will correct it and, where appropriate, reinstate the affected Trading Account or refund the charge.

12.6

Dishonest disputes. Where we reasonably believe a dispute was raised dishonestly, we may report it to payment providers, fraud prevention services and the authorities.

Next13 Evaluation programs and funded accounts

13Evaluation programs and funded accounts

13.1

Each evaluation is governed by its own product-specific rules: its Plan Specification and the Trading Rules. References in the Legal Documents to the CFDs Challenge Terms, the Futures Challenge Terms and the Instant Account Terms refer to the Plan Specification and to the part of the Trading Rules for that Product Line.

13.2

Customers must comply with:

  1. profit objectives;
  2. drawdown limits;
  3. trading restrictions;
  4. prohibited strategies;
  5. payout requirements; and
  6. consistency requirements where applicable.
13.3

Violation of program rules may result in warnings, disqualification, suspension, account closure, or forfeiture of eligibility.

13.4

Product Lines. WhitePips offers three Product Lines: CFDs, traded on MetaTrader 5 with one-step and two-step Evaluations; Futures, traded on Volumetrica with dxFeed market data, with Evaluations and a plan funded at purchase; and Instant, which issues a Funded Account at purchase without an Evaluation. The Plans in each line are described in the Trading Rules.

13.5

Passing an Evaluation. An Evaluation stage is passed when its objectives are met without a breach. Passing makes you eligible to move to the next stage or to a Funded Account, subject to review and verification. It creates no other entitlement.

13.6

Review before funding. Before a Funded Account is issued we may review the trading on the Evaluation, and we may decline to issue it where the review finds Prohibited Conduct or a breach. The Evaluation is then treated as failed.

13.7

Funded Accounts. A Funded Account remains a simulated account. Payouts from it are governed by the Payout Policy.

13.8

Resets. Challenge Resets and Funded Resets are available only as described in the Trading Rules.

13.9

Plan Specification fixed at purchase. The figures in the Plan Specification recorded at purchase apply to that Trading Account for its life, except where the Trading Rules allow a change. The conduct rules in the Trading Rules apply in their current version.

13.10

Maximum Allocation. The combined account size of all Trading Accounts held by one person, across all Product Lines and whether held directly or through someone else, may not exceed US$1,500,000 (shown on the Website as $1.5M), or any other limit shown on the Website at the time. We may refuse an order that would exceed it. Where the limit has been exceeded, we may close the most recently issued Trading Accounts and refund their Fees, unless the limit was exceeded through Prohibited Conduct, in which case section 17 (Consequences of a breach) applies.

Next14 Instant funding programs

14Instant funding programs

14.1

Instant funding products are governed by their respective product terms: their Plan Specification and the part of the Trading Rules that applies to Instant Accounts.

14.2

WhitePips may:

  1. review trading activity;
  2. conduct manual risk assessments;
  3. suspend payouts pending investigation; and
  4. terminate accounts for rule violations or abusive behaviour.
14.3

Participation does not guarantee continued access to funded accounts.

14.4

Activity requirement. Instant Accounts carry a minimum trading activity requirement, set out in the Trading Rules. An Instant Account that does not meet it may be closed after a written warning.

14.5

No fee refund with a payout. Unless its Plan Specification says otherwise, the Fee for an Instant Account is not refunded with the first payout.

Next15 Prohibited conduct

15Prohibited conduct

15.1

Users must not:

  1. exploit software bugs;
  2. manipulate platform functionality;
  3. abuse promotions;
  4. use stolen payment methods;
  5. impersonate another person;
  6. submit false documents;
  7. engage in fraudulent activity;
  8. interfere with platform security;
  9. distribute malware;
  10. scrape or copy platform data;
  11. reverse engineer proprietary software; or
  12. engage in market abuse or unlawful conduct.

You must also not, and must not try to, do any of the following.

15.2

Exploiting the simulated environment. Use any strategy that relies on or takes advantage of latency, delayed or stale prices, price feed errors, off-market quotes, incorrect spreads, swaps or commissions, or any other error or weakness of the simulated environment, including latency arbitrage, reverse arbitrage and tick scalping against delayed data.

15.3

Arbitrage and hedging across accounts or firms. Take positions on a Trading Account that offset, hedge or arbitrage positions on another account, whether that account is yours, belongs to someone else, or is held with another proprietary trading firm, broker or exchange, including opposite trades designed so that one account passes or profits whichever way the market moves.

15.4

Collusion and group trading. Coordinate trading with other people, share risk or outcomes with them, or trade as part of a group that places the same or opposing trades across different customers’ accounts.

15.5

Copy trading between users. Copy trades from, or allow your trades to be copied to, another person’s account, follow a signal service or signal provider, copy a shared or group master account, use an account manager or a paid “passing” service, or trade a strategy supplied by someone else in a way that mirrors other customers’ accounts. Where a Plan Specification permits a trade copier, it may only be used to copy your own trading: between Trading Accounts that you own and trade yourself, within the same product line (CFD with CFD, futures with futures), or from a master account that you genuinely own, trade and control, including one held with another broker or proprietary trading firm.

15.6

Account sharing and third-party management. Let anyone else trade or access your Trading Accounts, trade someone else’s account, use or offer account management, passing or “funded account” services, or buy Trading Accounts for someone else.

15.7

Automation where it is not permitted. Use expert advisors, bots, scripts or other automated trading unless the Plan Specification expressly permits it; where it is permitted, use any expert advisor or bot that you did not genuinely develop, own and control, including pre-purchased, rented, subscription and mass-market “plug-and-play” software; or, in any case, use automation for high-frequency trading, to exploit the simulated environment, or in a way that places the same trades as other customers using the same software. We may ask you to explain, provide or demonstrate an expert advisor under section 16 (Monitoring and trade review).

15.8

Gap and news exploitation. Trade scheduled news or market gaps in any way the Trading Rules prohibit, including trading news where the Plan Specification does not permit it.

15.9

Masking your location. Use a VPN, proxy, Tor, remote desktop, virtual private server or any other means to hide your real location or identity, or to access the Services from a Restricted Jurisdiction. Running a permitted expert advisor on a hosted server is not location masking, as long as you disclose it when asked and do not use it to conceal where you are.

15.10

Multiple Accounts and identities. Register more than one Account, register an Account in someone else’s name, let someone register in yours, or use several identities, devices, payment methods or addresses to get around limits, bans or the Maximum Allocation.

15.11

Abusive behaviour. Threaten, harass, abuse or discriminate against WhitePips staff, contractors or other customers in any channel, or send communications intended to disrupt our operations.

15.12

Misrepresenting your relationship with us. Claim or imply that you are employed by, authorised by, or trade real capital for WhitePips, use our name or marks without permission, or sell signals, courses or services that claim to be endorsed by us.

15.13

WhitePips reserves the right to investigate suspected misconduct.

15.14

Futures accounts. On a futures account, the strategies and behaviours prohibited, and the consequence of each, including those that end the account without a warning once confirmed, are set out in Trading Rules, section 20.7 (Prohibited trading strategies on futures accounts), in addition to this section.

Next16 Monitoring and trade review

16Monitoring and trade review

16.1

Monitoring. WhitePips monitors Accounts and Trading Accounts through automated systems and manual review. Monitoring may examine order timing, size, direction and duration, the instruments and sessions traded, IP addresses, devices and browser data, payment and wallet data, links between accounts and customers, and information received from Trading Platforms and data providers.

16.2

Any trade, at any time. We may review any trade or Trading Account at any time, including after an Evaluation has been passed and after a payout has been paid.

16.3

Manual review. While a review is open we may place the affected Trading Accounts in a manual review state, pause progression to a new stage, and hold payout requests. The Trading Rules describe what happens during a review.

16.4

Your cooperation. You must cooperate with a review, including by explaining your strategy, providing any expert advisor or script you used, providing documents, and joining a short video call if asked. Not cooperating within a reasonable time may be treated as a breach.

16.5

Our determination. We make determinations reasonably and in good faith on the information available to us. A determination is final, subject to the complaints process in section 30 (Complaints) and to your rights under applicable law. We do not have to disclose the details of our detection methods.

Next17 Consequences of a breach

17Consequences of a breach

17.1

Measures available to us. Where we determine that you have breached these Terms, a Plan Specification or the Trading Rules, we may take one or more of the following measures, in proportion to the breach:

  1. issue a warning or record a strike;
  2. require a Challenge Reset, or restrict features, instruments or position sizes;
  3. exclude the affected trades, and the Simulated Profit from them, when measuring objectives or payouts;
  4. suspend or terminate the affected Trading Account, other Trading Accounts connected with the breach, or your Account;
  5. void Simulated Profit and decline pending payouts;
  6. keep Fees without refund;
  7. recover payouts or fee refunds already paid, as described below; and
  8. refuse future purchases by you, or by persons, devices or payment methods connected with you.
17.2

A hard breach is not misconduct. A hard breach of a loss limit or drawdown ends the affected account stage under the Trading Rules. That is a normal outcome of an Evaluation, not misconduct, but the Fee for that Trading Account is not refunded.

17.3

Recovery of rewards obtained in breach. A payout, fee refund, Store Credit or other benefit that was paid or issued as a result of Prohibited Conduct, fraud, false information, a breach discovered later, or an error was not validly earned, and you must repay it promptly when we ask. For payouts made in cryptocurrency, the amount to repay is the US dollar value of the payout when it was made. We may set the amount off against anything otherwise due to you and may recover it by any other lawful means.

17.4

Connected accounts. Where a breach involves more than one Trading Account, or accounts of other people acting with you, we may apply these measures to all of them.

17.5

Proportionality. We aim to act proportionately. For a first, minor and inadvertent issue we will usually give a warning before taking further action, unless the Trading Rules set out a specific consequence.

Next18 Suspension and termination

18Suspension and termination

18.1

WhitePips may suspend, restrict, or terminate any Account at its discretion where it reasonably believes:

  1. these Terms have been breached;
  2. fraud has occurred;
  3. identity cannot be verified;
  4. payment disputes arise;
  5. prohibited trading behaviour is detected; or
  6. continued access poses a security or compliance risk.
18.2

Termination does not affect accrued rights or obligations.

18.3

Immediate suspension. We may suspend access without notice where we reasonably consider it necessary to protect the Services or other customers, to comply with the law or a request from an authority, or to investigate suspected Prohibited Conduct.

18.4

Termination for other reasons. We may also end any Service, Trading Account or Account for any other reason, including a business, legal or regulatory reason, the withdrawal of a Product Line or Trading Platform, or a change to our risk policies, by giving notice to your registered email address or in your dashboard. Where we do this and you are not in breach:

  1. for a Trading Account in an Evaluation stage that has not been breached, we will refund the Fee paid for it or, if you agree, give you a replacement Trading Account of equal value; and
  2. for a Funded Account in good standing, eligible Simulated Profit up to the termination date will be available for payout under the Payout Policy, including its review and verification requirements.
18.5

Effect of suspension or termination. Access to the affected Trading Accounts ends, open positions may be closed at the prevailing simulated prices, and, where termination is for a breach, Simulated Profit and unpaid payouts are forfeited.

18.6

Reasons. Where it is practical and lawful, we will tell you the reason for a suspension or termination. We do not have to disclose information that would reveal our detection methods or that the law does not allow us to disclose.

18.7

Ending by you. You may stop using the Services and close your Account at any time as described in section 6 (Account registration and security).

Next19 Trading Platforms, data feeds, outages and errors

19Trading Platforms, data feeds, outages and errors

19.1

Third-party Trading Platforms. CFD and Instant Trading Accounts are traded on MetaTrader 5, and Futures Trading Accounts on Volumetrica with market data supplied over a dxFeed connection. These are third-party products. You must comply with their licence terms and acceptable use rules, and WhitePips does not control how they operate.

19.2

No guarantee of availability. The Platform, Trading Platforms, data feeds, hosting and internet connections may be interrupted, delayed, degraded or unavailable, including during maintenance, periods of high volatility, and daily or weekly market breaks. WhitePips does not guarantee uninterrupted or error-free access and is not liable for the consequences of an interruption, including a missed trade, a position that could not be closed, a failure to reach an objective, or a breach.

19.3

Your own equipment. You are responsible for your own devices, software, internet connection and any server you use, and for their failure.

19.4

Price and calculation errors. Simulated prices and account calculations can occasionally be wrong, for example because of an off-market price, a price spike, a stale or frozen feed, an incorrect spread, swap or commission, an order filled or rejected in error, a requote, or a miscalculation of balance, equity, drawdown or objectives.

19.5

Our right to correct errors. Where we identify such an error we may, acting reasonably and within a reasonable time, correct the price or calculation, adjust or cancel the affected trades, remove any Simulated Profit or loss that resulted, and restore the Trading Account to the position it would have been in without the error. Where a Trading Account was breached only because of a verified error of this kind, we may reinstate it.

19.6

Reporting errors. You must report a suspected error to [email protected] promptly, and in any case within three Trading Days, with the account number, the ticket numbers and a description. You must not keep trading to take advantage of an error you are aware of.

19.7

Slippage is not an error. Slippage, gaps and fills at a worse price than requested in fast or thin markets are normal market behaviour. They count towards loss limits and drawdown like any other loss, and a stop order does not guarantee an exit price.

19.8

Trading conditions. Symbol lists, trading hours, contract specifications, spreads, commissions, swaps and platform settings are set on the Trading Platform and may change with market conditions. Instrument availability is not a term of any Plan.

19.9

Migration. We may move Trading Accounts to a different server, Trading Platform or data provider. When we do, we will take reasonable steps to keep account balances, status and Plan Specification unchanged.

19.10

Futures market data. Market data for Futures Trading Accounts is supplied by dxFeed under the market-data agreement you sign with dxFeed, in which you declare whether you are a Non-Professional or a Professional Subscriber. Each new Futures Trading Account you buy, or that we issue to you, includes 30 days of market data at the non-professional rate. After that, market data costs $35 for each further 30 days, which you pay from your dashboard; nothing renews automatically. The professional rate is set by the exchange and is not covered by WhitePips. If you declare yourself a Professional Subscriber, you pay the professional fee of $540 for each calendar month, which the exchange does not pro-rate, and market data is switched on only once that month is paid. If you do not wish to pay it, you may ask for a refund under the Refund Policy, section 5.6. When a paid period or professional month ends without payment, market data is switched off at the next market close and the Futures Trading Account cannot be traded until you pay. The account is kept, and the Trading Rules, including the inactivity rule, continue to apply to it.

Next20 Third-party services

20Third-party services

20.1

The Services may integrate with or link to third-party providers.

20.2

WhitePips is not responsible for:

  1. third-party websites;
  2. payment providers;
  3. identity verification vendors;
  4. analytics providers;
  5. Trading Platforms and market data providers;
  6. blockchain networks, wallets and exchanges;
  7. external software; or
  8. internet connectivity.
20.3

Use of third-party services is subject to their own terms and policies.

20.4

No endorsement. A link to, or integration with, a third party is not an endorsement of it. To the fullest extent permitted by law, WhitePips has no liability for the acts or omissions of third-party providers that are outside its reasonable control.

20.5

Trademarks. MetaTrader 5, Volumetrica and dxFeed are trademarks of their respective owners and are used only to identify the platforms and data services the Services run on.

Next21 Intellectual property

21Intellectual property

21.1

All content available through the Services, including trademarks, logos, graphics, designs, software, databases, documentation, videos, and written materials, is owned by WhitePips or its licensors.

21.2

No content may be copied, reproduced, modified, distributed, sold, or republished without prior written consent.

21.3

Your licence. Subject to these Terms, WhitePips grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and use the Website and the Platform for your own participation in the Services. The licence ends automatically when your Account is closed or you breach these Terms.

21.4

Restrictions. You must not frame or mirror the Website; use bots, crawlers, scrapers or other automated means to access the Website or dashboard; remove proprietary notices; register domain names or social media handles confusingly similar to ours; or use our name, logo, plan data or rules in advertising or products without our written permission.

Next22 User content, community and feedback

22User content, community and feedback

22.1

If you submit reviews, suggestions, testimonials, feedback, or other content, you grant WhitePips a worldwide, royalty-free, perpetual, non-exclusive licence to use, reproduce, modify, publish, and display such content for business purposes, subject to applicable law.

22.2

Your responsibility for content. Content you submit must be your own, truthful and lawful. It must not infringe anyone’s rights, disclose another person’s personal data, contain fabricated or edited account results, or promote Prohibited Conduct.

22.3

Community channels. WhitePips may run community spaces, such as a Discord server and social media pages. Their platform rules apply as well as these Terms, and we may moderate or remove content and remove members at our discretion.

22.4

Ideas and feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

Next23 Confidentiality

23Confidentiality

23.1

Information that WhitePips gives you and that is not public, including review outcomes, details of risk controls and internal thresholds, unreleased products, and correspondence we mark as confidential, is confidential. You may use it only for your own participation in the Services and must not disclose it to anyone else.

23.2

This section does not stop you from giving information to a regulator, law enforcement authority or court, or to your own legal, tax or financial advisers under a duty of confidentiality, from disclosing it where the law requires you to, or from giving an honest review of your own experience.

Next24 Marketing, publicity and testimonials

24Marketing, publicity and testimonials

24.1

Marketing messages. We may send you marketing communications as described in the Privacy Policy. You can opt out at any time; service, security and account messages will continue.

24.2

Publicity with your consent. With your consent, which we will ask for separately, WhitePips may publish your first name or chosen alias, your country, your account size, payout amounts, a payout certificate, your testimonial and statistics about your trading, on the Website, on social media and in marketing materials. You may withdraw consent for future use at any time. We will then remove the material from channels we control where reasonably practicable, but we cannot recall material already printed, broadcast or shared by others.

24.3

Honest testimonials. Testimonials must reflect your genuine experience. We may shorten or edit them for clarity without changing their meaning. Where a testimonial was rewarded, we will say so where the law requires.

24.4

Illustrative content. Examples, stories, figures and statistics shown on the Website or in marketing are illustrative. Content marked as illustrative is not a record of a real customer’s results. Individual results vary, and nothing in our marketing is a promise that you will pass an Evaluation or receive a payout.

24.5

Partners. Partners are independent businesses, not agents of WhitePips. They are bound by separate partner terms, and their statements are not made on our behalf.

Next25 Privacy

25Privacy

25.1

Your use of the Services is also governed by our Privacy Policy, and by our Cookie Policy, which explains how we use cookies and similar technologies.

25.2

By using the Services, you acknowledge that personal information may be processed in accordance with that policy.

Next26 Disclaimer

26Disclaimer

26.1

The Services are provided on an “as is” and “as available” basis.

26.2

To the fullest extent permitted by law, WhitePips disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, availability, accuracy, uninterrupted service, and non-infringement.

26.3

WhitePips does not guarantee profits, successful evaluations, funding, payouts, or uninterrupted platform availability.

26.4

Simulation is not the market. WhitePips does not warrant that simulated prices, fills, liquidity or execution match those of any live market, and educational content, market commentary and examples are general information that may be incomplete or out of date.

26.5

Local law. WhitePips does not warrant that the Services are lawful or appropriate in your country. You use them on your own initiative and are responsible for complying with your local law.

26.6

Statutory rights. Nothing in these Terms excludes a warranty or right that cannot be excluded under the law that applies to you.

Next27 Limitation of liability

27Limitation of liability

27.1

To the fullest extent permitted by law, WhitePips, its directors, employees, affiliates, contractors, licensors, and partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Services.

27.2

Losses we are not liable for. To the same extent, WhitePips is not liable for:

  1. loss of profit, revenue, business, opportunity, goodwill or data, whether direct or indirect;
  2. loss of Simulated Profit or of an expected payout, or the loss of a chance to pass an Evaluation or reach a scaling milestone;
  3. losses caused by outages, errors, delays or failures of the Platform, a Trading Platform, a data feed, a payment provider, a blockchain network or the internet;
  4. losses caused by a payout being sent to the bank account, wallet address or network you provided, or by fees and delays of banks, intermediaries or blockchain networks;
  5. losses caused by your breach of the Legal Documents, or by unauthorised use of your Account resulting from your failure to keep it secure; or
  6. losses caused by your reliance on educational content, examples or marketing.
27.3

Where liability cannot legally be excluded, WhitePips’s aggregate liability shall not exceed the total amount paid by the customer to WhitePips during the twelve (12) months preceding the event giving rise to the claim.

27.4

How the cap works. The cap applies to all claims together, whether in contract, tort (including negligence), breach of statutory duty or otherwise. The amount paid means Fees actually received by WhitePips, less refunds. Payouts you have received are not amounts paid to WhitePips.

27.5

What is not limited. Nothing in these Terms limits or excludes liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any other liability that cannot be limited or excluded by law.

27.6

Allocation of risk. These limits reflect a fair allocation of risk in light of the price of the Services, and they apply even if WhitePips was told that the loss was possible.

Next28 Indemnification

28Indemnification

28.1

You agree to indemnify and hold harmless WhitePips and its affiliates from any claims, liabilities, losses, damages, costs, expenses, or legal fees arising from:

  1. your breach of these Terms;
  2. misuse of the Services;
  3. violation of applicable law;
  4. infringement of third-party rights;
  5. Prohibited Conduct, including by anyone you allowed to use your Account;
  6. a chargeback or payment dispute raised in breach of section 12 (Chargebacks and payment disputes);
  7. content you submit; and
  8. taxes, duties or contributions due on payouts you receive.
28.2

Handling claims. WhitePips may take control of the defence of any claim covered by this section, and you must cooperate with it.

Next29 Force majeure

29Force majeure

29.1

WhitePips shall not be liable for any delay or failure caused by events beyond its reasonable control, including natural disasters, internet outages, cyberattacks, governmental actions, labour disputes, pandemics, acts of war, or failures of third-party providers.

29.2

Further examples. Such events also include the failure or suspension of a Trading Platform, data feed, exchange or liquidity source, extreme market events, congestion, forks or failures of a blockchain network, the failure of a payment provider or bank, and new or changed sanctions, laws or regulatory requirements.

29.3

Effect. While such an event continues, our affected obligations are suspended. If it continues for an extended period, we may end the affected Services under section 18 (Suspension and termination).

Next30 Complaints

30Complaints

30.1

How to complain. If you are unhappy with any part of the Services, write to [email protected] from the email address registered to your Account, with “Complaint” in the subject line. Include the Trading Account or order concerned, what happened, and what you would like us to do. References in the Legal Documents to the Complaints Policy refer to this section.

30.2

What we will do. We will acknowledge your complaint, investigate it fairly, and aim to send you a final response within thirty (30) days. If we need longer, we will tell you why.

30.3

Appealing strikes and review outcomes. You may appeal a strike, warning or review outcome through this process. The outcome stays in effect while the appeal is considered, and a hard breach can be appealed only on the ground that the measurement was wrong.

30.4

Before any claim. You agree to use this process, and the negotiation step in section 32 (Dispute resolution), before starting any formal claim.

Next31 Governing law

31Governing law

31.1

These Terms are governed by and construed in accordance with the laws of Saint Lucia, without regard to conflict-of-law principles.

31.2

Non-contractual matters. Non-contractual disputes arising out of or in connection with these Terms or the Services are also governed by the laws of Saint Lucia.

Next32 Dispute resolution

32Dispute resolution

32.1

Before commencing any formal proceedings, you agree to first seek to resolve any dispute arising out of or relating to these Terms or the Services through good-faith negotiation by sending written notice of the dispute to [email protected]. The parties shall attempt in good faith to resolve the dispute within thirty (30) days of receipt of that notice.

32.2

If the dispute is not resolved within that period, the dispute shall be subject to the exclusive jurisdiction of the courts of Saint Lucia.

32.3

To the extent permitted by applicable law, disputes must be brought on an individual basis only, and not as a plaintiff or class member in any class, collective, or representative action.

32.4

Class action waiver. To the same extent, you waive any right to take part in a class, collective or representative action against WhitePips, and your claim may not be joined with other customers’ claims without WhitePips’s consent.

32.5

Time limit for claims. To the extent permitted by applicable law, a claim arising out of or relating to these Terms or the Services must be started within one (1) year after the facts giving rise to it occurred or, if later, within one (1) year after you became aware, or should reasonably have become aware, of them. A claim started later is barred.

32.6

Nothing in this section limits any mandatory consumer rights available to you under the laws of your country of residence.

32.7

Urgent relief and debts. Nothing in this section prevents WhitePips from seeking urgent injunctive or protective relief, or from recovering a debt, in any court with jurisdiction.

Next33 Changes to these Terms

33Changes to these Terms

33.1

WhitePips may update these Terms from time to time.

33.2

Updated versions become effective upon publication on the Website unless otherwise stated.

33.3

Continued use of the Services after updates constitutes acceptance of the revised Terms.

33.4

Notice of material changes. Where a change is material, we will also take reasonable steps to tell you in advance, for example by email or in the dashboard, unless the change is needed urgently to comply with the law, to address a security or fraud risk, or to prevent Prohibited Conduct.

33.5

Trading Accounts already bought. A change does not alter the figures in the Plan Specification of a Trading Account you have already bought, except as allowed by section 13 (Evaluation programs and funded accounts).

33.6

If you do not agree. If you do not agree with a change, you must stop using the Services, and you may close your Account.

33.7

Versions. Each version of these Terms carries a version number and an effective date. Earlier versions are available on request.

Next34 Assignment, waiver and relationship

34Assignment, waiver and relationship

34.1

Assignment. You may not assign, transfer or subcontract any of your rights or obligations under the Legal Documents. WhitePips may assign or transfer its rights and obligations to an affiliate or to a successor to all or part of its business, and will tell you where the transfer affects you.

34.2

No waiver. If WhitePips does not enforce, or delays enforcing, a right or rule, that is not a waiver of it. A waiver is effective only if given in writing, and only for the specific instance.

34.3

Third-party rights. No one other than you and WhitePips may enforce these Terms, except that the persons named in section 27 (Limitation of liability) and section 28 (Indemnification) may rely on those sections.

34.4

Relationship. Nothing in the Legal Documents creates an employment, partnership, joint venture, agency or fiduciary relationship between you and WhitePips.

Next35 Severability

35Severability

35.1

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

35.2

Minimum change. Where possible, an invalid or unenforceable provision will be treated as changed to the smallest extent needed to make it valid and enforceable.

Next36 Entire agreement and order of precedence

36Entire agreement and order of precedence

36.1

These Terms, together with any applicable product-specific terms, the Privacy Policy, the Risk Disclosure, the Trading Rules, the Payout Policy, the Refund Policy, the Restricted Jurisdictions policy, and other legal notices published by WhitePips, constitute the entire agreement between you and WhitePips concerning the Services.

36.2

No reliance on other statements. You confirm that you have not relied on any statement, promise or representation that is not set out in the Legal Documents, including statements made by support staff, community moderators or Partners, or on social media.

36.3

Order of precedence. If the Legal Documents conflict, the following order applies, and the earlier item prevails:

  1. mandatory law that applies to you;
  2. the Plan Specification of the Trading Account concerned, for its figures;
  3. the Trading Rules, for trading conduct, objectives, breaches and resets;
  4. the Payout Policy and the Refund Policy, for payouts and refunds respectively;
  5. the Restricted Jurisdictions policy and the Privacy Policy, for their own subject matter;
  6. these Terms; and
  7. the Risk Disclosure, which explains risks and does not reduce any obligation above, and FAQs, guides, product pages and marketing materials, which are for information only and do not form part of the agreement.

Next37 Notices, communications and language

37Notices, communications and language

37.1

Notices to you. We may give you notices by email to your registered address, in your dashboard, or by publishing them on the Website. An email notice is treated as received on the day it is sent, unless we receive a delivery failure message.

37.2

Notices to us. Notices to WhitePips must be sent to [email protected]. Formal legal notices may also be sent by post to WhitePip FX Ltd., Unit 1, La Place Creole Building, Rodney Village, Rodney Bay, Gros-Islet, Saint Lucia, or to our office at Business Center, Sharjah Publishing City Free Zone, Sharjah, United Arab Emirates.

37.3

Electronic communications. You agree to receive communications, agreements and records electronically, and agree that they satisfy any legal requirement for writing.

37.4

Language. These Terms and the other Legal Documents are written in English. Any translation is provided for convenience only, and the English version prevails if there is any difference.

37.5

Our records. Our records of your Account, orders, trading and communications are evidence of what they record unless shown to be wrong.

Next38 Survival

38Survival

38.1

Every provision that by its nature should continue after your Account or a Trading Account ends continues to apply, including those on fees and chargebacks, consequences of a breach and recovery of rewards, confidentiality, intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution.
